DGA Privacy Policy

Consistent with the Directors Guild of America's ("DGA") mission as a labor organization that represents the creative and economic rights of directors and members of the directorial team working in film, television, commercials, documentaries, news, sports and new media, the DGA is committed to protecting your privacy. The following privacy policy ("Privacy Policy") states the DGA's policies regarding collection, use and processing of information that we collect about you through our website www.dga.org (the "Website") or through other means, including paper submissions, that can be used to directly or indirectly identify you as an individual ("Personal Data"). As used in this Privacy Policy, "you" includes any identifiable individual, including members of the DGA and non-members.

This Privacy Policy is effective as of May 24, 2018. Residents of the European Economic Area ("EEA"), which includes the member states of the European Union ("EU"), should consult the sections of this policy relating to the "Rights of EEA Residents" and "International Data Transfers" for provisions that may also apply to them..


Information We Collect

There are two types of information that we may collect from you: (1) Personal Data, which includes information that may be used to directly or indirectly identify an individual, including your name, e-mail address, physical address, phone number, tax identification information, social security or identification number, earnings information, gender, ethnicity and other information about you; and (2) Usage Data, which is anonymous data collected if you are not logged in to the Website about your use of the Website that is not linked to you personally and may not be used to identify you.

You may enter the Website and browse its contents without submitting any Personal Data. However, if you submit information to us through the Website or communicate with us through other means regarding membership, contracts, benefits, earnings, payments, residuals, foreign levies, projects on which you were employed or other matters, we may at that time collect Personal Data about you. When you submit Personal Data to us, you consent to the collection, use and disclosure of your Personal Data for the purposes set forth in this Privacy Policy. In addition, we collect, use and process Personal Data to provide you with benefits and services, including collective bargaining agreement negotiations and enforcement, processing and delivery of residual payments and foreign levies payable for the exploitation of film, television and other programs on which members were employed. Your Personal Data is also used by us to send you periodicals, including the DGA Monthly and DGA Quarterly, as well as occasional e-mail communications and communications regarding matter such as dues, benefits, award screeners and other matters.

If you connect to our Website through a third-party website, such as Facebook, we do not collect any Personal Data regarding you unless you provide such through our Website. Third-party websites are governed by their own separate privacy policies.

Whether or not you submit Personal Data to the DGA, we may collect, store or accumulate certain Usage Data based on your use of our Website, such as information regarding which of our pages are most popular, the browser you use, your computer's IP address, and the URL you visited immediately prior to using our Website and the URL you visited immediately after using our Website. Such information is not linked to any Personal Data that we collect about you.


Uses, Processing and Sharing of Information

We use and process the Personal Data that we collect from you to respond to your requests, inform you of relevant information and events, maintain and develop our Website, communicate with you, and to calculate and provide you information about your rights and benefits, including earnings, dues payments, residuals payments and foreign levies, and to fulfill contractual obligations. If you do not provide us with Personal Data about yourself we will not be able to provide you with certain information and services. You will be given an opportunity to opt out of receiving certain publications and award screeners, but you cannot obtain certain benefits and services from us without submitting your Personal Data for processing by the DGA.

We share some of your Personal Data with the DGA-Producer Pension and Health Plans related to your pension and health benefits. We contract with companies or individuals to provide certain services, including software development, mailing of publications and award screeners ("Service Providers"). We may share your Personal Data with Service Providers only to the extent necessary for them to perform their functions. We do not share your Personal Information unless it is necessary to fulfill our responsibilities, including providing information, services or benefits to you. We will not disclose, rent, sell or share any Personal Data with unaffiliated third parties for marketing purposes.

We may use Usage Data in aggregate form for internal purposes, such as generating statistics and usage information. We may share or transfer such aggregate, non-personally identifiable Usage Data to Service Providers for administrative, analytical, research, optimization, security or other purposes, but no such information will be linked with your Personal Data or be used to identify or contact you.

We may share your Personal Data: (i) in response to subpoenas, court orders, or other legal process; (ii) to establish or exercise our legal rights; (iii) to defend against legal claims; (iv) in conjunction with collective bargaining negotiations or enforcement; or (v) as otherwise required by law.

We may also share your Personal Data when we believe it is appropriate to (i) investigate, prevent, or take action regarding illegal or suspected illegal activities; or (ii) to protect and defend the rights, property or safety of the DGA, you or other persons.

We will not share your Personal Data if such sharing is prohibited by applicable privacy and data protection law, including, without limitation, the EEA's General Data Protection Regulation effective May 25, 2018 ("GDPR").


EEA Residents

This section of the Privacy Policy is applicable to residents of the European Economic Area ("EEA"). The EEA consists of the member states of the European Union, i.e., Austria, Belgium, Bulgaria, Croatia, Republic of Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and the United Kingdom, and Iceland, Liechtenstein, and Norway. This section also applies to residents of Switzerland and, in the event of its departure from the EU, residents of the United Kingdom. Residents of the EEA and Switzerland are referred to here as "EEA Residents."

From May 25, 2018, all processing of Personal Data of EEA Residents is performed by the DGA in accordance with the GDPR (2016/679 Regulation of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons regarding the processing of Personal Data and on the free movement of such data).

Under the GDPR, the DGA is both the controller and processor of the Personal Data of EEA Residents. The DGA's purpose for collecting and processing Personal Data from EEA Residents is related to their membership in the DGA and their access to the Website, to inform EEA Residents regarding relevant information and events, to maintain and develop the Website, to communicate with EEA Residents regarding their rights, benefits and services provided by the DGA, to calculate earnings, residuals payments, and foreign levies from their employment on film, television and other programs, and to fulfill contractual obligations. The legal basis for collecting Personal Data is the consent of EEA Residents to obtain services, fulfillment of our members' contractual obligations, and benefits from the DGA's legitimate interest in providing services and benefits to EEA Residents. If EEA Residents do not provide Personal Data to the DGA or they withdraw consent for processing such Personal Data, the DGA may not be able to provide such residents with information regarding their rights, or provide benefits and services to them, including those rights conferred by contract.

EEA Residents may obtain information about the Personal Data that the DGA holds about them by consulting the membership portal on the Website or through the procedures set forth below in "Your Rights and Obligations."


International Data Transfers

If you are resident outside the United States, including in the EEA, we transfer Personal Data provided by you for processing in the United States. Under the GDPR, the DGA is considered a "controller" and a "processor" of the Personal Data of EEA Residents. By providing Personal Data to the DGA for the purpose of obtaining benefits and services, you consent to the processing of such data in the United States. The transfer of your Personal Data to the United States is necessary for the performance under the DGA Constitution and Bylaws, or for the performance of a collective bargaining agreement or contract concluded in your interest between the DGA and third parties. Please note that the United States does not have data protection laws equivalent to those in the EEA and other jurisdictions.


Security

We take commercially reasonable and appropriate technical and organizational precautions to protect your Personal Data against loss, misuse, unauthorized disclosure, alteration, and destruction. However, please remember that no transmission of data over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Data, we cannot ensure or warrant the security of any information that you transmit to us or from us, and you do so at your own risk.

In addition, while we take commercially reasonable steps to govern our Service Providers' use and protection of your Personal Data, we ultimately have no control over and are not responsible for the privacy practices of such parties.

Cookies

In order to improve your user experience, we may use cookies, web beacons or similar tracking technologies. These "Cookies" are small pieces of information that are stored by your browser on your computer's hard drive. Generally, Cookies work by assigning to your computer a unique number that has no meaning outside of the Website. Our Cookies do not generally contain any personally identifying information. Children Under 13

We do not knowingly collect or solicit Personal Data directly from anyone under the age of 13. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. If we learn that we have collected Personal Data from a child under age 13, we will delete that information as quickly as possible. If you are a parent or guardian of a child under 13 years of age and you believe your child has provided us with Personal Data, please contact us at dataprivacy@dga.org.


Opting Out

When registering your membership account on our Website, you will have the ability to "opt in" to receiving DGA e-mails, publications and award screeners. Alternatively, if you initially decide to receive e-mails, publications and award screeners from us but at a later date decide you no longer wish to receive those communications, you can opt out through the member portal of the Website or by contacting one of the DGA membership representatives.

You do not have the ability to opt out from providing other information to us. If you opt out from receiving DGA e-mails, publications and screeners, we will still contact you with information related to your earnings, benefits, and certain other information relating to your membership, but there are other items you might not receive as a result.


Links to Third Party Websites

Our Website or emails may contain links to third party websites to which we have no affiliation. Except as set forth in this Privacy Policy, we do not share your Personal Data with those websites and are not responsible for the privacy policies of any other website or its management of your Personal Data. Because they may treat your data differently than we do, we suggest you read the privacy policies on those third-party websites prior to submitting any Personal Data.


Your Rights and Obligations

If you are a resident of the EEA and wish to access the Personal Data that the DGA has about you or have any questions relating to the processing of your Personal Data, please contact us at dataprivacy@dga.org with the subject line "GDPR Data." You may also update certain Personal Data through a password protected portal on our Website, as well as review the Personal Data we maintain on the Website through the portal.

If you use the Website, you are responsible for maintaining the confidentiality of your account and for restricting access to your computer or device, and you agree to accept responsibility for all activities that occur under your account.


Changes to this Privacy Policy

We may change this Privacy Policy from time to time by publishing a new version on our website. We may notify you of changes to this policy by email or on the website.
